voluntary repo question?

if u purchase a used car then return in voluntarily within 72 hrs, plus the dealer keeps the car u gave for a trade-in, r u still responsible 4 the balance of the car’s price after they sold it at auction? car was returned cuz of problems driving w/stick shift. the sales guy said we could return it if we were’nt satisfied w/it. now the car store wants us 2 pay the difference for it.

I am going to assume that the dealer is also the finance source. (such as a Buy Here Pay Here dealer)

Unless you have it in writing that the dealer would buy the car back from you for the balance owed, what happened is that you voluntarily allowed the car to be repossessed. The dealer then sold the car for less than the amount that you owed, and now you are liable for the difference.

Verbal representations are not binding on a car sales contract. The salesman wanted to make a sale. He most likely told you that if you were not happy, you could bring it back and trade it in on another car, not just return it.

Sorry but you will have to pay the amount owed.

Absolutely. You signed a contract to repay money you borrowed to buy the vehicle. You gave the vehicle back – doesn’t matter if it was 10 minutes later, but the money still has to be paid back. You can’t just return a car after you bought it, new or used. If the sales guy said you could return it, I hope you got that in writing. You not only have ruined your ability to obtain financing for the next 7 years, you get to pay for a car you will never drive.

Sorry, you signed a contract. You must abide by the terms of that contract whether you have the car or not. Giving it back was a really dumb thing to do. If you couldn’t drive a manuel transmission car why did you buy one?
