Has anybody ever had GMAC lie to them Just so they can repo your car?

Ok I was late on my payments and I called GMAC on 9th and told them I can pay the full bill by the 20th. and that I will be getting some money the next day and would sent that to them in the mail the next day. They said that would be fine but if they did not get the full 3 payments they would repo the truck on the 21st. I told them that if I could not pay by then I would surrender the truck to avoid all the extra cost and they said ok. They took my truck on the 14th. The check I mailed to them for one payment was cashed by them on the 13th. In my book that would only make us 2 payments short and I feel they should have waited. I got the money on 20th like I promised but to get my truck back they wanted the last 2 payments and one forward plus repo fees of $600.00.

I live on Maui and they take the repoed cars to Oahu for auction but I made the payment and the repo guy said that the truck was still here and as soon as he got the paper work to release it I can get it. I called the head repo office in Oahu and they said they have not got any paper work yet and did not know where my truck was. I asked them to call me back when they found it and got the paper work. They said they would and they did call back and said they just got the release form. I asked where do I have to go to get it and they said that the truck was shipped to Oahu that morning and that I would have to pay the shipping cost to and from Oahu. They said it would be a few days to get the totals together and they would call back. She called me back as promised but she said it would be a few more days. I waited 2 day and then started calling them as I did not want to pay storage fees. I called from 27th to 30th with no answers and no call backs. I then called her manager and she said that they have been waiting for payment from me. She said they had the total 3 days ago and charged me $1,580.00 to get it back but they could not ship it now because I missed the shipping turn in date. But she will get it on the Feb 3rd ship. and it will take 2 more days to before I can pick it up.

So 22 days it will be to get my truck back and $2,180.00 in extra cost. Does anybody think this is fair? and has anybody had a story like this? and did you report them to the BBB.org? and what did the BBB.org do for you.

I tried calling several lawyers but they won’t touch this case. I guess they feel it is below them. I was also fired from 2 good paying jobs and I would like to get compensation of up to $25,000.00 as that is the total of the 2 contracts I had lost plus the fees they charged by lying to me.

Anybody know a lawyer that will take on this case?
We are working with the home lender and I am not looking for the grow up kind of answers. We made a deal and they lied is the point of the question. I did not blame anyone for my lack of cash flow. I just want the unneeded ransom fees to go toward the truck payment instead of in everybody else’s pockets.

You don’t have a case. No lawyer is going to take this one. You must grow up and abide by the legal contracts that you sign. You owe the money and must pay up. Stop trying to blame the company for your faults. I hope remembered to pay your housing costs this month or you’ll try to live in a truck!

I think they are guilty of consumer fraud, and you might be able to go after them for the shipping charges and the repo fees, but it will probably be hard to get the compensatory damages for the contracts that you lost as a result of not having the truck. I listen to Bill Handel’s Handel on the Law radio program, and he says that you can’t get a lawyer interested unless there is a lot of money to be had for the least effort. So your best bet would be to try small claims court to get back the $2180.

Handel has a website (see below) that lets you search for lawyers, but I don’t know if it has affiliates in Hawaii. Nevertheless, it is worth checking out because it will give some advice on how to do small claims court.

BBB won’t do anything except take your report. If somebody asks them about GMAC before doing business with them, they will show them your report. Unfortunately, nobody ever thinks to check with the BBB BEFORE dealing with a business. I would think GMAC would be more ethical than they have been with you, but I guess not.
