There’s a notice that says

“You have been sued in court. If you wish to defend against the claims set forth in the following pages, you must take action within 20 days after this complaint and notice are served, by entering a written apperance personally or by attorney and filing in writing with the court your defenses or objections to the claims set forth against you. You are warned that if you fail to do so the case may proceed without you and a judgement may be entered against you by teh court without further notice for any money claimed int he complaint or any other claim or relief requested by the plaintiff. ”

I can not offord a lawyer, at all. So what do i do? I emailed the lawyer that is representing Ford seeing if we can settle this outside court and set up a payment service. I do not recall at all ford ever sending me something to set up payments. I do know when you do a Voluntary Repo, they take the car to the auction and you owe the difference. Well, its my understanding that they send something to resolve it, so I do not know if I never got it, or they never did, or what. But I like to handle this outside court, because I really dont want to go through them freezing my bank account.

Advice would be great! I’m willing and can set up a payment system, but is that even out of the question now? Oh yeah I’m in Pennsylvania.

In late March to early April of 2008 my family signed a 12 month lease at a house in Tucson, AZ. Not soon after we found out that the previous owners had not been paying there mortgage and that the home was being repo’d. On 9-29-08 the house was sold at auction and today we received a note on the door saying that we are going to be evicted .
Now, my question is, can this be legal? We still have at least 6 more months on our lease. I would also be glad to hear some suggestion on what actions I should take.

NOTE: another thing that might be helpful to you is that we are not renting from the previous owner we are renting from a property management company.

tractor repoed no jugement not taken to court. collection agency only. how long can they try to collect after sold at auction for balance.

I have a $1700 dvd/nav system installed in the car along with 20 rims. Am I allowed to take that property back also? I’m in Kansas. Those items are expensive but are not going to increase the value at an auction.
for one no I didn’t know they were coming to get it. I planned on being caught up this coming friday and the bank knew that but didn’t seem to care. They are demanding the key since they don’t have one well I can tell you they won’t be gettting a key untill I get my stereo equipment and rims back. Those are not part of the car that I have the loan on so they have no right to keep it.

I had been paying steady for two years. I missed 4 payments due to other financial obligations. I had just moved to a new place and it took some time to get settled in, only to move again within 4 months. I received note that they were going to repo my truck in two weeks unless I payes $x,xxx. I came up with $200 less than what I owed them and called them a few days before doomsday. They said they needed the full amount and 3 days later, they took my truck, added another $500 for tow/repo fines, and told me that needed to be payed within so many days before they shipped my truck form TN to OH for auction. Now they want over $5k for the truck, and I’m left with nothing. What are my options in this matter? Do I have any rights? Bancruptcy? Thanks for any intelligent advice.

Here’s the breakdown of events:

Lost a job in March that led to deficit in our home income. We were 90 days behind on a vehicle lease loan with Fifth Third Bank – we had been calling them for months trying to work something out, and they were completely unforgiving. They finally said they were coming out to repossess our car.

This past Friday: Called Fifth Third Bank and said that we could make a 2/3rds payment on what was past due on our car. They said it needed to be the full 90 days. We said we could do something over the weekend and pay on Monday. The customer service rep said we had until Monday and she noted out account.

Sunday at 6am: Our car is involuntary repossessed while we slept. Called the police later in the morning to find our car had been taken to a local repossession lot. When we called the lot, they said that Fifth Third hadn’t informed them that we had until Monday. They said we needed to call Fifth Third on Monday morning to discuss.

Monday at 7am: We called Fifth Third. The rep says that she sees the note on our account, but that doesn’t matter. She said someone should have explained the risks to us, and they could repo our car anytime, no matter what we were told. We made the payment via Western Union for our car. We are told that once the paperwork is sent to the repossession lot, our car will be released to us. We are told this will at least take a day. We call the repossession lot at the end of the day to see if paperwork has been received, and it has not.

Tuesday: We call the repossession lot to see if the paperwork has been received, and it has not. We call Fifth Third, and they tell us to call back on Wednesday. They said these things take time.

Wednesday (TODAY): We call the repo lot. They tell us our car has been transferred to the auction lot. They tell us our car will be up for auction on Monday. After some argument, we find out that Fifth Third places a 72 hour hold on cars repossessed, and that we’ll have to pay all these fees incurred for the time. Fifth Third still has not sent them (or US) ANY paperwork regarding this matter. We’ve only found out all this information by calling these places trying to piece this together.

TONIGHT: We are told by the repo lot that they will not sell our car because we have a confirmation number for our payment. However, we’ll still be responsible for all the fees.

My question is – WE PAID ON MONDAY. WE WERE TOLD WE COULD HAVE UNTIL MONDAY TO PAY. And the note saying that is on our account. Do we have a legal case? I know we defaulted on the loan, and that is our fault, but don’t we have some rights here? Shouldn’t what the representative told us on Friday hold some weight as a verbal contract or agreement with us?

Please help. I believe we’ll be contacting a lawyer in the morning, but we’re just feeling helpless. Thank you for anyone who takes the time to read this and offer advice.
Just as an extra note – the customer service rep we talked to on Friday didn’t even have our current address until we told her. So, she would have had to tell us we could have until Monday, then sent out a repo order after telling us that.

my car was repossessed and never even made it to the recovery company’s lot, it went straight to the auction company. i have since worked it out and had my car redeemed but now i have to go to the auction company to get my car and not the recovery company. actually i have to go to both places the recovery co to get my stuff and tag and the auction co to get my car and both places want money. i feel like i am getting scammed somehow cause on top of that i have to pay my finance co a $400.00 repossession fee. plus i cannot find the nc laws for repossessing a car anywhere at all!! i just want to know if the recovery was suppose to hold my car there or if they can send it n to the auction house with no time in between?

Back in December 07, I was 2 count them 2 payments behind on my car. The bank it was financed with (hint:jpc) called about it but never tried to do anything else. Then my friend who worked at a dealership was going to take my car as a trade in and put me in a new one (yay!). As soon as my bank got the call for the payoff, they lied to him saying that they did not have my record on file and my car within 3 weeks was repo’d. I had made a payment a week before that happened to keep it under the usual 90 day repo policy. Then a few weeks later i received a letter about an intention to sell. That was the last i had heard about it. Last weekend i was served papers stating that they are suing me for the car which i no longer have. And the amount owed doesnt seem like a balance left over from a car sale/auction (it was a fully loaded 2002 model vehicle, i got it for 12,500 and it was worth about 7k).If they had let me trade it in the first place this couldve been avoided. HELP
Add’l: when i had called the bank to get the payoff myself, they told me that they had reported the car stolen and there is a warrant on the car so if the dealership ran it thats what would show up. The whole thing seemed unfair and fishy to me.

My friend’s car was repo’d last Wednesday @ 9pm and it had full tank in it. When she drove to the place where the car was held today, it was being ready to be auctioned off WITHOUT her permission. When it was returned, the gas tank was empty (It took only 1/4 tank to get there) and the car mats had been removed/stolen. Does she have the right to sue the company that had taken the car?

This happened in Houston, TX btw.

if you are assuming she removed the mats herself or tried to pull off something to blame the repo co. she’s not. I was there when it happened and there are pictures of the mats before they took it to auction and she still has a receipt for the gas she pumped an hour before they took it.
