My ex husband & I purchased a truck in 03 & have since divorced. He took the responsibility to keep up the payments but gave up the truck voluntarily (repo) without my knowledge. He did not keep up with the payments so the creditors tried to work with me to get the account current or they will auction the truck. Well they auctioned the truck and now I owe the remaining balance due. My ex has since filed bankruptcy & everything was discharged. Now the creditor’s are garnishing my wages. I was the buyer and he was the co-buyer at the time. They can’t go after him because of his bankruptcy… Can I personally sue him to help me pay for this debt?

The same thing happened to me. I didn’t find out until they had already repo the car. I thought about doing the same. You can do it, but you will have a hard time getting anything out of it. They may ask you why you gave him the car if you were the buyer. Also they will ask why didn’t you remove your name from the truck before you gave it to him.
I know how you feel but they will say you could have sold him the truck by having the bank have him finance the car in his name. I hope you find way to get back at the bastard, good luck.
Damn, u have been had, big time. What did you do to **** him of like that?
I don’t think so? Not if he’s filed bandruptcy, it makes him safe for all past debts due from the time he filed.
